For the use of Designlub Apps, Designlub Website, and Services
This agreement applies as between you, the User of our apps, website, and services, and Designlub. Your agreement to comply with and be bound by these Terms and Conditions is deemed to occur upon your first use of the Color Planes – by Designlub app or our Website. If you do not agree to be bound by these Terms and Conditions, you should stop using our apps or this Website immediately.
No part of our apps or this website is intended to constitute a contractual offer capable of acceptance. Your order constitutes a contractual offer and our acceptance of that offer is deemed to occur upon our sending a confirmation email to you indicating that your order has been fulfilled.
1. Definitions and Interpretation
In this Agreement the following terms shall have the following meanings:
“Account” – means collectively your Apple iTunes Store or Google Play Store account;
“Content” – means any text, graphics, images, audio, video, software, data compilations and any other form of information capable of being stored in a computer that appears on or forms part of this Website or the Color Planes – by Designlub app;
“Designlub” – means Designlub;
“Service” – means collectively any online facilities, tools, services or information that Designlub makes available through the Color Planes – by Designlub app or website either now or in the future;
“Payment Information” – means any details required for the purchase of Services from this Website or App. This includes, but is not limited to, credit/debit card numbers and bank account details;
“Purchase Information” – means collectively any orders, invoices, receipts or similar that may be in hard copy or electronic form;
“System” – means any online communications infrastructure that Designlub makes available through our App or Website either now or in the future. This includes, but is not limited to, web-based email, message boards, live chat facilities and email links;
“User / Users” – means any third party that accesses the Website or App and is not employed by Designlub and acting in the course of their employment; and
“Website” – means Designlub.com unless expressly excluded by their own terms of use.
2. Intellectual Property
2.1 All Content included on the Color Planes – by Designlub app, this website, and Services, unless uploaded by Users, including, but not limited to, text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software is the property of Designlub, our affiliates or other relevant third parties. By continuing to use the Website and Services you acknowledge that such material is protected by applicable International intellectual property and other laws. 2.2 You may not reproduce, copy, distribute, store or in any other fashion re-use material from Color Planes – by Designlub or our website unless otherwise indicated on the Website or unless given express written permission to do so by Designlub.
3. Third Party Intellectual Property
3.1 Unless otherwise expressly indicated, all Intellectual Property rights including, but not limited to, Copyright and Trademarks in product images and descriptions belong to the manufacturers or distributors of such products as may be applicable. 3.2 You may not reproduce, copy, distribute, store or in any other fashion re-use such material unless given express written permission to do so by the relevant manufacturer or supplier.
4. Links to Other Websites
This Website or App may contain links to other sites. Unless expressly stated, these sites are not under the control of Designlub or that of our affiliates. We assume no responsibility for the content of such Websites and disclaim liability for any and all forms of loss or damage arising out of the use of them.
5. Use of Communications Facilities
5.1 When using the enquiry form or any other System on the Website you should do so in accordance with the following rules:
You must not use obscene or vulgar language;
You must not submit Content that is unlawful, abusive, threatening, harassing, defamatory, ageist, sexist or racist;
You must not impersonate other people, particularly employees and representatives of Designlub;
You must not use our System for unauthorised mass-communication (“spam”).
6. Accounts and Subscriptions
6.1 Color Planes – by Designlub may offer free-to-play content with limited access to specific video, coloring, or game features. 6.2 Subscriptions are typically provided on a monthly basis. 6.3 Payments will be charged to your iTunes Account or Google Play Store Account at confirmation of purchase. 6.4 Your subscription will be charged for renewal within 24-hours prior to the end of the current period. 6.5 Subscriptions may be managed by the user and auto-renewal may be turned off by going to the Account Settings after purchase.
7. Termination and Cancellation
7.1 You may terminate your Account at any time by adjusting your settings in the respective App Store. 7.2 If payments are cancelled prior to the commencement of Services, you will be refunded any monies paid in relation to those purchases.
8. Services, Pricing and Availability
8.1 Designlub reserves the right to change prices and alter or remove any special offers from time to time. 8.2 While we strive for accuracy, Designlub is not responsible for minor variations in Service descriptions within the Color Planes – by Designlub app.
9. Disclaimers
9.1 Designlub makes no warranty that Color Planes – by Designlub or the Website will meet your requirements, be fit for a particular purpose, or be compatible with all systems. 9.2 No part of this Website or App is intended to constitute advice and should not be relied upon when making decisions.
10. Limitation of Liability
10.1 To the maximum extent permitted by law, Designlub accepts no liability for any direct or indirect loss or damage, foreseeable or otherwise, arising from the use of Color Planes – by Designlub or our website. Users use the App and Website at their own risk.
11. Changes to the Terms of Use
Designlub reserves the right to change the Website, the Color Planes – by Designlub app, its Content or these Terms of Use at any time. You will be bound by any changes to the Terms of Use from the first time you use the Service following the changes.
12. Notices
All notices/communications shall be given to us by email to Info@designlub.com. Such notice will be deemed received the day of sending if received in full on a business day.
13. Law and Jurisdiction
These terms of use and the relationship between you and Designlub shall be governed by and construed in accordance with the Law of England and Wales. Both parties agree to submit to the exclusive jurisdiction of the Courts of England and Wales.
